The Art of Drafting Arbitration Clauses — Transforming Boilerplate into Strategic Advantage

Arbitration clauses are often seen as boilerplate, yet they can significantly affect the efficiency, cost, and outcome of disputes long after a contract is signed. Representatives from the London Court of International Arbitration (LCIA) will lead a session on common pitfalls in disputes arising from international commercial relationships and complex multi-party or multi-contract arrangements, including those common in the funds industry. Participants will get practical guidance on arbitrability, selecting the place of arbitration, choosing institutional rules, and drafting clauses to avoid costly jurisdictional disputes, with a focus on issues relevant to the Luxembourg market.

A moot-style debate on whether AI-assisted arbitrator selection enhances neutrality and efficiency, or threatens legitimacy and party autonomy — adversarial hearing, tribunal deliberation and short “award”, followed by an audience vote and debrief. With Tony Cole (Chair, JAMS), Omar Puertas (Harvey) and Michael Decker (Schjødt) for the Proposition, Benjamin Lissner (CMS) and Amanda Lee against, Laurie Achtouk-Spivak (Cleary Gottlieb) and Paulina Geschke (Jus Mundi) on the Tribunal, moderated by Giuseppe De Palo (JAMS).

15:45 – 16:30 — Luxembourg Arbitration: What’s New, What’s Next?
A panel on the adoption of the new Arbitration Law in 2023 and the continued modernisation of the Luxembourg Arbitration Center (LAC), bringing together an arbitrator, a judge, an academic and the LAC’s Secretary General to discuss efficiency, technology, artificial intelligence, financial disputes and the future of Luxembourg as an arbitral seat. With Thierry Hoscheit (President, Cour supérieure de justice), Olivier Cachard (Professor, University of Lorraine), Anne-Sophie Theissen (Secretary General, LAC) and André Prüm (President, LAA), moderated by Henri Dupong (Partner, Loyens & Loeff).

16:30 – 17:15 — On the Edge of Consent? Investment Funds’ Arbitration with Nominee, Sovereign and Retail Investors
A practical look at when and how an arbitration agreement embedded in fund documentation may be enforced against investors, their intermediaries, or sovereign entities raising immunity issues. With Fabio Trevisan (Partner, BSP), Maxime Berlingin (Partner, Fieldfisher) and Ada Schmitt (Partner, Clifford Chance), moderated by Karl Hinn (Senior Legal Counsel, DTCP).

17:15 – 17:30 — Closing Remarks
